Federal law pays overtime at one and a half times your rate for hours over 40 in a week. California adds a second trigger, over 8 hours in a single day, and pays overtime on whichever is larger. The two rules can produce the same weekly total from very different daily patterns, which is exactly where people miscount.

Worked example, four 10-hour days and one 8-hour day at $25/hour

That is a 48-hour week. Under both rule sets it comes to 40 regular hours and 8 overtime hours, and the same $1,300 of pay. But they get there differently:

The totals match here because the four long days each cross 8 hours by the same amount the week crosses 40. Change the pattern, five 9.6-hour days, say, and California pays more, because each day's overtime counts even though the week is still 48 hours.

Questions

Do I get overtime for working over 8 hours in a day?

Only in states with a daily overtime rule. California is the main one, at time-and-a-half over 8 hours and double time over 12. Under federal law and in most states, overtime is measured only by the weekly total, so a 10-hour day inside a 35-hour week earns no overtime.

Is my overtime taxed more?

No. Overtime pay is ordinary wages, taxed in your regular brackets. A single big paycheck can be withheld at a higher rate because payroll annualizes it, but that evens out at filing. This calculator shows gross overtime pay; for take-home, use the paycheck calculator.

What counts as time-and-a-half?

Your regular rate multiplied by 1.5. On a $25 wage that is $38 an overtime hour. The multiplier is adjustable in the calculator for double-time or contractual rates.

Are salaried workers owed overtime?

Some are. Being paid a salary does not by itself make you exempt, exemption depends on your duties and on earning above a federal salary threshold. Many salaried workers are non-exempt and owed overtime. A wage-and-hour agency or lawyer answers this for your job, not a calculator.

How is my blended rate useful?

It is total pay divided by total hours, what each hour of the week actually earned once overtime is counted. It is the honest number to compare against a flat-rate offer or a salaried role.
